Judge Tells Attorney “I’ll Beat Your Ass


A war of words between a judge and attorney in Florida ended after the judge allegedly punched the attorney in the head.

Judge John Murphy of Brevard County, Florida, challenged veteran public defenderAndrew Weinstock to a fight on Monday, and it was all caught on tape and obtained by WFTV.

The station reports that Murphy pressured Weinstock during court proceedings to make his client waive his right to a speedy trial.

“I’m not waiving,” Weinstock can be heard telling the judge.

The two men, seemingly frustrated with one another, start to get heated.

“You know, if I had a rock, I would throw it at you right now,” Murphy shoots back. “Stop pissing me off!”

Murphy tells Weinstock to sit down.

“I have a right to be here,” Weinstock says to the demand.

“If you wanna fight, let’s just go out back and I’ll beat your ass!” Murphy can be heard saying. Weinstock then walks away from the camera.

In the hallway and out of view from the courtroom cameras, Murphy allegedly grabbed Weinstock by the collar and punched him in the head, according to WGHP.

“You want to f**k with me?” one of the men is heard shouting during the brawl.

Two deputies broke up the altercation. Murphy then returned to the courtroom to applause, saying, “I will catch my breath eventually. Man, I’m an old man.”

Public Defender Blaise Trettis told Florida Today that Weinstock did not return to the courtroom, and that criminal charges won’t be pursued.

Weinstock was reassigned to another area so he and Murphy wouldn’t interact with one another.

The public defender’s office told WFTV that the incident will be reported to the Florida Bar.

Obama Vows To Flex Presidential Powers In State Of The Union 2014 Speech

WASHINGTON (AP) — Seeking to energize his sluggish second term, President Barack Obama vowed Tuesday night in his State of the Union address to sidestep Congress “whenever and wherever” necessary to narrow economic disparities between rich and poor. He unveiled an array of modest executive actions to increase the minimum wage for federal contract workers and make it easier for millions of low-income Americans to save for retirement.

“America does not stand still and neither do I,” Obama declared in his prime-time address before a joint session of Congress and millions of Americans watching on television.

Draped in presidential grandeur, Obama’s address served as the opening salvo in a midterm election fight for control of Congress that will quickly consume Washington’s attention. Democrats, seeking to cast Republicans as uncaring about the middle class, have urged Obama to focus on economic mobility and the gap between the wealthy and poor. His emphasis on executive actions was greeted with shouts of “Do it!” from many members of his party.

Declaring 2104 a “year of action,” Obama also sought to convince an increasingly skeptical public that he still wields power in Washington even if he can’t crack through the divisions in Congress. Burned by a series of legislative failures in 2013, White House aides say they’re now redefining success not by what Obama can jam through Congress but by what actions he can take on his own.

Indeed, Obama’s proposals for action by lawmakers were slim and largely focused on old ideas that have gained little traction over the past year. He pressed Congress to revive a stalled immigration overhaul, pass an across-the-board increase in the federal minimum wage and expand access to early childhood education — all ideas that gained little traction after he proposed them last year. The president’s one new legislation proposal calls for expanding an income tax credit for workers without children.

Republicans, who saw their own approval ratings fall further in 2013, have also picked up the refrain of income inequality in recent months, though they have cast the widening gap between rich and poor as a symptom of Obama’s economic policies.

“Republicans have plans to close the gap, plans that focus on jobs first without more spending, government bailouts and red tape,” said Rep. Cathy McMorris Rodgers, R-Wash., in the Republicans’ televised response to the president’s speech.

The economy and other domestic issues, including health care, dominated the president’s address. He touched only briefly on foreign policy, touting the drawdown of American troops from Afghanistan this year and reiterating his threat to veto any new sanctions Congress might levy on Iran while nuclear negotiations with the Islamic republic are underway.

Even as Washington increasingly focuses on income inequality, many parts of the economy are gaining strength, with corporate profits soaring and the financial markets hitting record highs. But with millions of Americans still out of work or struggling with stagnant wages, Obama has found himself in the sometimes awkward position of promoting a recovery that feels distant for many.

“The cold, hard fact is that even in the midst of recovery, too many Americans are working more than ever just to get by, let alone get ahead,” Obama said. “And too many still aren’t working at all.”

The president garnered some of his loudest applause — at least from Democrats — when he took on lawmakers who oppose his signature health care law, which floundered in its initial rollout last fall. Obama said that while he doesn’t expect to convince Republicans on the merits of the law, “I know that the American people aren’t interested in refighting old battles.”

The president’s speech drew an eclectic mix of visitors to the House chamber. Among those sitting with first lady Michelle Obama were two survivors of the Boston Marathon bombing, as well as Jason Collins, an openly gay former NBA player. Republican House Speaker John Boehner brought business owners from his home state of Ohio who say Obama’s health care overhaul is hurting their companies. Willie Robertson, a star of the television show “Duck Dynasty,” also scored a seat in the House gallery, courtesy of the Republicans.

Though Obama sought to emphasize his presidential powers, there are stark limits to what he can do on his own. For example, he unilaterally can raise the minimum hourly wage for new federal contractors from $7.25 to $10.10, as he announced, but he’ll need Congress in order to extend that increase to all of America’s workers.

The executive order for contractors, which Obama will sign in the coming weeks, is limited in its scope. It will not affect existing federal contracts, only new ones, and then only if other terms of an agreement change.

Republicans quickly panned the executive initiative as ineffective. Said Boehner: “The question is how many people, Mr. President, will this executive action actually help? I suspect the answer is somewhere close to zero.”

White House officials countered by saying many more working people would benefit if Congress would go along with Obama’s plan to raise the minimum wage across the board.

“Give America a raise,” Obama declared.

Among the president’s other executive initiatives is a plan to help workers whose employers don’t offer retirement savings plans. The program would allow first-time savers to start building up savings in Treasury bonds that eventually could be converted into traditional IRAs. Obama is expected to promote the “starter” accounts during a trip to Pittsburgh on Wednesday.

The president also announced new commitments from companies to consider hiring the long-term unemployed, the creation of four “manufacturing hubs” where universities and businesses would work together to develop and train workers, new incentives to encourage truckers to switch from dirtier fuels to natural gas or other alternatives and a proposed tax credit to promote the adoption of cars that can run on cleaner fuels, such as hydrogen, natural gas or biofuels.

The president’s go-it-alone strategy is in many ways an acknowledgment that he has failed to make good on two major promises to the American people: that he would change Washington’s hyper-partisanship and that his re-election would break the Republican “fever” and clear the way for congressional action on major initiatives.

Some Republicans have warned that the president’s focus on executive orders could backfire by angering GOP leaders who already don’t trust the White House.

Obama isn’t abandoning Congress completely. He made a renewed pitch for legislation to overhaul the nation’s fractured immigration laws, perhaps his best opportunity for signing significant legislation this year. But the odds remain long, with many Republicans staunchly opposed to Obama’s plan for creating a pathway to citizenship for the 11 million people already in the U.S. illegally.

Seeking to give the GOP some room to maneuver, Obama did not specifically call for a citizenship pathway Tuesday, saying only, “Let’s get it done. It’s time.”

Opening a new front with Congress, the president called for an extension of the earned-income tax credit, which helps boost the wages of low-income families through tax refunds. Obama wants it broadened so that it provides more help than it does now to workers without children, a view embraced by some Republicans and conservative economists.

Obama singled out Republican Sen. Marco Rubio of Florida, who has proposed replacing the tax credit with a federal wage supplement for workers in certain low-paying jobs. Unlike Obama, however, Republicans have suggested expanding the tax credit as an alternative to increasing the minimum wage.

Pivoting briefly to foreign policy, Obama reaffirmed that the U.S.-led war in Afghanistan will formally conclude at the end of this year. But he said a small contingent of American forces could be left behind if the Afghan government quickly signs a bilateral security agreement, a prospect that looks increasingly uncertain.

The president also warned lawmakers in both parties against passing new economic sanctions against Iran while the U.S. and international partners are holding nuclear negotiations with the Islamic republic. He renewed his commitment to veto sanctions legislation if it passes, arguing that a new round of penalties would upend the sensitive diplomacy.

President Barack Obama has been placed under citizens arrest for using arbitrary power [an act of war] against the portion of government secured to conventions of the people in each of our several states. for attempting to infringe and for construing to deny or disparage the things free people can freely do while going about their liberties. [taking property by force instead of by asking].
The Department of Justice still has not come up with an arresting officer.

So this domestic enemy of our constitution remains at large. He is believed to be surrounding himself with people willing to give aid to a person who has placed themselves into a state of war against the laws of this land.

The end is nigh! The sky is falling! Tiered Internet premiums are coming, secret backdoor dealings to speed some services and slow others on the way! That’s some of what I have read recently in regards to the Appeals Court decision to strike down FCC net neutrality in favor of Verizon. Now if you don’t know, Verizon spends millions in anti-consumer lobbying already, apparently, they might have swayed the minds of some judges somehow. It seems the judges do not understand the concept of zeros and ones and what it means to data transmission.

Granted, right now things look pretty bleak for consumers, what with Amerika Inc. spreading its oily tendrils throughout every facet of life and conditions slowly sinking for many consumers, not to mention the absolute erosion of U.S. citizen privacy. The latest pro-corporation ruling probably won’t be the last, or even the straw that breaks the proverbial camel’s back just yet.

Castle Rock apartment tenants told they must get rid of their guns

CASTLE ROCK – Retired Marine Art Dorsch says his Second Amendment rights are in danger.

 

His apartment complex, the Oakwood Apartments in Castle Rock, sent out a notice telling all residents to get rid of their guns.

The 77-year-old retired US Marine Corps veteran sent a newstip to 9Wants to Know saying he’s afraid he’ll be homeless if he doesn’t comply.

The letter went out to residents on August 1 and says they have until October 1 to comply with updated “community policies.”

On page 2 is a brand new provision saying “firearms and weapons are prohibited.”

“It upsets me very much,” Dorsch said.

As of October 1, residents cannot display, use, or possess any firearms or weapons of any kind, anywhere on the property.

“I’m a hunter. I’m a licensed conceal and carry person,” Dorsch said.

Dorsch says the guns, which he keeps securely locked in a safe, make him feel secure in his home.

“They want to take them all away from me. They say I can’t live here,” he said.

Dorsh says apartment managers told him to give up the guns and stay, give notice and move out voluntarily, or be forced to move out if he doesn’t comply with the new policy.

Nobody answered the door at the apartment office on Tuesday afternoon.

When reached by phone, Brooke Young, Ross Management Group regional manager, said “It’s our policy not to comment to the news media,” before hanging up.

“The best thing this tenant can do is either move out or get rid of the guns,” 9NEWS legal analyst Scott Robinson said.

Robinson says, in most cases, courts have supported the rights of landlords to impose “reasonable regulations” on tenants.

“The question is: is an outright ban of firearms reasonable in light of the US Constitution?” Robinson said.

Dorsch says the issue goes beyond the Second Amendment.

“I’m vulnerable. I’m not safe,” Dorsch said.

If he loses his guns, Dorsch says he loses so much more.

“My freedom,” Dorsch said. “Yeah it’s emotional. Because I don’t think it’s fair.”

Dorsch says he barely has enough money to live, never mind hire a lawyer.

So, if he’s not able to fight the new rules, he says he’ll have no choice but to leave his guns with a friend who lives 30 miles away.

He hopes he’ll still be able to go hunting, as he has every year since 1953.

WASHINGTON — Secretary of State Hillary Rodham Clinton is leaving office with a slap at critics of the Obama administration’s handling of the September attack on a U.S. diplomatic mission in Libya. She told The Associated Press that critics of the administration’s handling of the attack don’t live in an “evidence-based world” and their refusal to “accept the facts” is unfortunate and regrettable for the political system.

In her last one-on-one interview before she steps down on Friday, Clinton told the AP that the attack in Benghazi was the low point of her time as America’s top diplomat. But she suggested that the furor over the assault would not affect whether she runs for president in 2016.

Although she insisted that she has not decided what her future holds, she said she “absolutely” still plans to make a difference on issues she cares about in speeches and in a sequel to her 2003 memoir, “Living History,” that will focus largely on her years as secretary of state.

Clinton spoke to the AP Thursday in her outer office on the seventh floor of the State Department less than 24 hours before she walks out for a final time as boss. She was relaxed but clearly perturbed by allegations from Republican lawmakers and commentators that the administration had intentionally misled the public about whether the attack was a protest gone awry or a terrorist attack, or intentionally withheld additional security for diplomatic personnel in Libya knowing that an attack could happen.

NJ dad wears Nazi uniform to child custody hearing


ImageA New Jersey father who made headlines after naming his son ‘Adolf Hitler’ has marched in to a court wearing a Nazi uniform.

Heath Campbell, 40, from Holland Township, gained national attention back in 2008 when a store refused to put his son’s name on a birthday cake.

Campbell has since become estranged from his wife, Deborah, after their children were put into foster care in 2011. He was at the Hunterdon County Family Court in Flemington fighting for the right to visit his youngest son, Heinrich Hons Campbell, 2.

“I’m going to tell the judge, I love my children. I want to be a father, let me be it,” Campbell told NBC10 outside court.
